Undesignated parties may not import

This restricts WHO may import rather than imposing a licence: the State Bank designates and authorises the facility, and the original confirmation must be filed with customs alongside the dossier.

The mechanism is DESIGNATION OF TRADERS, not licensing. Article 1 of Circular 38/2018/TT-NHNN (unamended) states that import proceeds "by the trader-designation method provided in Appendix II issued with Decree 69/2018/ND-CP" — Appendix II of Decree 69/2018 is the "trader designation" list, while Appendix III is the "by licence, by condition" list. Article 3.2 of Circular 38/2018: "The State Bank shall issue a written designation permitting money-printing and minting facilities to import the goods in clause 1 of this Article." The appendix prints codes as three separate Chapter, Heading and Subheading cells and states NO code-level principles and no general exception. Repeated HS codes across rows are faithful to the source, because the key is the goods name.

What does designated importer only involve?
1. Only money-printing and minting facilities designated by the State Bank may import goods in the list. The new Article 4 (as amended by 07/2023): "The Governor delegates to the Director of the Department of Issuance and Vault the issuance of the confirmation…". At import, the facility submits one original of the State Bank’s confirmation to customs with the customs dossier.
