Chemicals requiring an incident prevention and response plan

The duty attaches to storage and arises only above the quantity threshold printed in the appendix — it does not attach to the act of importing.

An incident prevention and response Plan must be approved — if storage EXCEEDS the threshold

This duty attaches to STORAGE, not to importing. Under Article 37.1(b) of the Law on Chemicals 69/2025, an organisation or individual operating a facility that stores a listed chemical “above the threshold set in clause 2 of this Article” must have the Plan approved by the competent authority BEFORE storing it. Each chemical’s threshold is printed in the “maximum quantity stored at any one time (kg)” column of Table A, Appendix IV of Decree 24/2026/NĐ-CP. BELOW the threshold no Plan is required, but Measures for incident prevention and response must still be drawn up and issued under Article 38 — two different procedures; “below threshold” does not mean “nothing to do”.

Only above it is an approved Plan required; below it, Measures under Article 38 still apply.
