Rule 1 - Classify by heading terms and Notes
The titles of Sections, Chapters and subChapters are provided for ease of reference only; for legal purposes, classification shall be determined according to the terms of the headings and any relative Section or Chapter Notes and, provided such headings or Notes do not otherwise require, according to the following provisions.
Always consider FIRST. Classification must rest on the terms of the 4-digit heading and any relative Section/Chapter Notes; Section and Chapter titles are for ease of reference only and carry no legal force. Only when the heading and Notes do not settle the matter do you move on to Rules 2–6.
Common mistake: Classifying by the Chapter title instead of the heading terms plus the relative Notes.
