Most codes in this appendix do not exist in the Vietnamese tariff

The appendix uses the nomenclature of the Chemical Weapons Convention list rather than the Vietnamese tariff: 7 of its 10 codes (2931.9080, 2931.9020, 2930.9099, 2921.1999, 2931.00, 3002.90 and 6-digit 2930.90) return nothing in the Vietnamese tariff — the real corresponding lines are 29319090, 29309090, 29211900 and 30029000. Consignments must therefore be checked by CAS number, not HS code. Two codes do match but are broader than the ban: 2524.90.00 also covers chrysotile asbestos (not among the banned amphiboles), and 2904.10.00 covers all sulphonated hydrocarbon derivatives.

For a substance actually on the list, both trade and import are barred

Where the consignment genuinely is a listed substance (checked by CAS number), the ban bites at two levels at once: Article 6.1(b) of the Law on Investment prohibits TRADE, and Decree 292/2026/ND-CP Appendix I Section II item 3 places it among import-PROHIBITED goods (item 22 for amphibole asbestos specifically). There is no commercial import licence to apply for.

Research, testing, healthcare and defence follow separate decrees

Article 6.2 of the Law on Investment preserves a route for producing and using these substances in analysis, testing, scientific research, healthcare, pharmaceutical manufacture, crime investigation and defence or security — "as prescribed by the Government". It is a purpose-based exception requiring the relevant sector decree; the Law itself sets out no procedure.

THE LIST IS KEYED ON CAS NUMBER AND SUBSTANCE NAME, NOT ON THE HS CODE — the table prints a separate CAS column, and 7 of the appendix’s 10 codes DO NOT EXIST in the Vietnamese import-export nomenclature. The appendix copies its codes in the Combined-Nomenclature style used for the Chemical Weapons Convention Schedule 1 list (written 4+4 with a single dot and endings 80/99/20, e.g. 2931.9080), unlike Vietnam’s 4+2+2 split; looking up 2931.9080, 2931.9020, 2930.9099, 2921.1999, 2931.00 or 3002.90 in the Vietnamese tariff returns nothing, the actual corresponding lines being 29319090, 29309090, 29211900 and 30029000. The three codes that do match — 2524.10.00, 2524.90.00 and 2904.10.00 — are precisely those written in Vietnamese format, and the latter two are BROADER than the ban: 2524.90.00 "Asbestos - Other" also covers serpentine-group chrysotile, which is not among the amphiboles banned here, while 2904.10.00 covers all sulphonated hydrocarbon derivatives, not only DBSA.
