Certify conformity with QCVN 01-188:2018/BNNPTNT at a designated body, declare conformity, then register for state quality inspection before clearance.

No self-assessment, and no clearance before inspection

High-risk goods must be certified by a DESIGNATED certification body — unlike the medium-risk goods of Appendix I, which may rely on self-assessment. Article 4.2 places high-risk goods under specialised inspection BEFORE clearance, so a consignment cannot proceed until state quality inspection has been registered.

Anything outside heading 38.08 is not in Appendix II

Appendix II lists only plant protection products under heading 38.08. Plant varieties, fertilisers, animal feed, veterinary drugs and every other agricultural item sit in Appendix I at MEDIUM risk — the duty there is a declaration of conformity before the goods circulate, not border-stage state inspection.

Pre-1 July 2026 certificates still work

Conformity certificates and declaration receipts issued before 1 July 2026 remain usable to their stated expiry, and applications filed before that date but not yet decided are handled under the rules in force when they were filed (Article 7.1–7.2).

What decides whether your goods are in it

Article 4.2: high-risk products and goods “are placed on the list of goods subject to specialised inspection before customs clearance under customs law”; the organisation or individual must self-declare the applied standard, and a DESIGNATED certification body must certify conformity with the applicable national technical regulation. The appendix’s “corresponding quality-management requirement” column states: declaration of conformity based on certification by a designated body; conformity-assessment schemes 5 and 7 under Circular 14/2026/TT-BKHCN; imported goods undergo state quality inspection as prescribed by law. Article 5.2: where listed goods carry no HS code, or the code in the list differs from the one determined under customs law, the HS code follows customs law and the inspection authority applies management measures based on the NATURE, COMPOSITION and USE of the goods — the HS code alone is not decisive.

    Article 7.1: conformity certificates and declaration-of-conformity receipts issued for goods within the circular’s scope before 1 July 2026 remain valid until their stated expiry. 7.2: certification applications received before 1 July 2026 but not yet decided continue under the rules in force when they were received. 7.3: conformity-assessment bodies already designated for “group 2” goods, whose designation is still valid, may keep assessing under this circular until that designation expires.

    27/2026/TT-BNNMT takes effect

    The list starts to apply on this date. 16/2021/TT-BNNPTNT is repealed.
