What to do if your goods fall in Appendix II

Obtain conformity certification from a certification body (no self-assessment route) under PT1, PT5 or PT7, register for state inspection with the Department of Construction, then file the declaration of conformity.

Note: 10/2024/TT-BXD was replaced by 41/2026/TT-BXD on 2026-07-01. What follows is the obligation while it was in force, kept for checking files handled before that date.

1. Article 8.2(a): register for state quality inspection with the Department of Construction. Obtain conformity certification from a body registered in the field or designated by the Ministry of Construction, under scheme PT1, PT5 or PT7 as shown in the appendix’s last column (Article 13.1, referring to Circular 28/2012/TT-BKHCN). File the declaration of conformity with the inspection body in the province of business registration (Article 12.4). — Department of Construction (the "inspection body") — in one of: the province of business registration or of a representative office, branch or plant; the province of the entry border gate; the province where customs formalities are carried out

What decides whether your goods are in it

Article 12.2: "Declaration of conformity rests on one of the following: (a) certification results from a certification body registered in the field or recognised by law; (b) certification or inspection results from a certification or inspection body designated by the Ministry of Construction." — BOTH options are third-party certification; there is NO self-assessment route, so the obligation is certification plus declaration, not declaration alone. The table’s fourth column states the state-inspection point per row ("Before clearance." / "After clearance."). Article 3.4: goods not listed, or where HS classification differs, take their code from customs law, and after clearance the importer notifies the Ministry of Construction so the list can be updated.

Validity milestones for this list

1. Before 2024-12-16

   The cut-off is the export-clearance date in the exporting country

   Article 20.2: "Consignments of construction materials that completed export formalities in the exporting country (for import into Vietnam) before this circular took effect are subject to the earlier rules." The cut-off is export clearance in the EXPORTING COUNTRY, not the Vietnamese import declaration date. Article 20.1: conformity certificates under QCVN 16:2023/BXD issued before the effective date and still valid remain usable, with their conformity mark, until they expire.

2. 2024-12-16

   10/2024/TT-BXD takes effect

   The list starts to apply on this date.

3. 2026-07-01

   41/2026/TT-BXD replaces 10/2024/TT-BXD

   From this date, consignments must be checked against the new list.
