File the declaration of conformity through the National Database on Standards, Metrology and Quality; only if that database fails or is incomplete may it be filed in person or by post with the inspection body (Article 12.5). The Department of Construction (inspection body) receives state-inspection registrations; the Ministry of Construction designates conformity-assessment bodies (Article 14). The specialist unit inside the ministry is the Department of Science, Technology, Environment and Construction Materials.

Article 12.2(a): "For high-risk products and goods, declaration of conformity rests on certification results from a certification body DESIGNATED BY THE MINISTRY OF CONSTRUCTION" — narrower even than Circular 10/2024, which also allowed bodies merely registered in the field. Article 8.2(b) limits state inspection of imports to the high-risk group only, so that obligation does not reach Appendix III. Appendix note **: for slag, ash and waste-gypsum lines, "import follows the law on environmental protection". The appendix no longer carries a pre/post-clearance column — that timing now sits in Articles 82–83 of Decree 37/2026/ND-CP.

    Article 17: standard- and regulation-conformity certificates under QCVN 16:2023/BXD issued before 2026-07-01 remain valid until their stated expiry; designated bodies continue operating within their designated scope and term. Article 17.3: products under QCVN 16:2023/BXD that are NOT in Appendix II or III are managed as LOW risk. Products in Appendix II or III with no corresponding QCVN yet declare an applied standard until one exists. ⚠️ The circular has NO provision for consignments that completed export or import formalities before 2026-07-01 — the equivalent clause in Article 20.2 of Circular 10/2024/TT-BXD has disappeared.

    41/2026/TT-BXD takes effect

    The list starts to apply on this date. 10/2024/TT-BXD is repealed.
